i got a car from dennis eakin that i am currently making payments on. i was 6 months pregnant when my boyfriend an i were trying to change the tire on a level street. the jack folded into an %26quot;L%26quot; shape and nearly landed on my foot, and my husbands hand. i went back to the dealer and they offered to trade in my car for another car. but so far they have not been sucessful. seems likebecause im upside down in the car ( i owe more than its worth) no one will finance me and help me out. what can i do legally? my car is worth 10,000 and i owe 13,875. i just want to trade in my unsafe car....are there any legal actions i can take aginst the dealership? and the dealership has admitted they do have to inspect the jack and spare tire before selling it.How do i get them to take back my car?1) you can sell it and thake the hit.

That is not applicable under the Lemon Law, you are stuck with it. You insurance should pay to repair any damage done. The dealer may offer to repair the vehicle, but you aren't likely to get a new one.

If you tried to take this to court the dealer would probably claim %26quot;operator error%26quot; as the reason why the jack failed. You might be able to get some kind of liability case for them giving you a bad jack, especially if it wasn't strong enough to handle the car in the first place.
